State Officials Assets Report (LHKPN)

As a manifestation of the responsibility of the Company’s officials to the nation, PT TIMAH Tbk implements LHKPN reporting for Company officials that refers to the following provisions:

  1. Law No. 28 of 1999 concerning State Officials who are Clean and Free of Corruption, Collusion, and Nepotism;
  2. Corruption Eradication Commission of the Republic of Indonesia Regulation No. 7 of 2016 concerning Procedures in Registration, Announcement, and Examination of State Official's Assets;
  3. Corruption Eradication Commission of the Republic of Indonesia Regulation No. 2 of 2020; as an Amendment on Corruption Eradication Commission Regulation No. 7 of 2016;
  4. Company Regulation No. 0001.A concerning Amendment and Re-establishment of Company Regulation Number 0007/Tbk/PER-0000/20-S11.1 concerning Procedures for Reporting, Announcement, and Management of State Administration Assets Reports (LHKPN) within PT TIMAH Tbk and Subsidiaries.

The LHKPN is submitted to the Corruption Eradication Commission (KPK), where the public can widely access the information through the KPK’s official website, www.kpk.go.id. The report is submitted annually as PT TIMAH Tbk’s support for the efforts to prevent corruption, collusion, and nepotism in state governance.

LHKPN Management

The Company appoints the Corporate Secretary Division of GCG and Compliance Department to establish coordination with KPK in the monitoring as well as evaluation of compliance with the implementation of LHKPN in PT TIMAH Tbk. Meanwhile, in the Company’s internal, the management of LHKPN is supported by the issuance of the President Director of PT Indonesia Asahan Aluminum (Persero) Letter No. 042/L-II/ dated 7 February 2018 regarding the Obligation to Report LHKPN Holding of the Mining Industry, which was made based on KPK regulations. Referring to the letter, Company officials who are required to carry out LHKPN are as follows:

  1. Board of Commissioners of PT TIMAH Tbk;
  2. Board of Directors of PT TIMAH Tbk;
  3. Officials at the level of Senior Vice President of PT TIMAH Tbk;
  4. Officials at the level of Vice President of PT TIMAH Tbk;
  5. Board of Commissioners of PT TIMAH Tbk’s Subsidiaries; 
  6. Board of Directors of PT TIMAH Tbk’s Subsidiaries.

Pursuant to KPK Regulation No. 07 of 2016, starting from January 1, 2017, the submission of LHKPN is conducted electronically through the e-LHKPN web-based application, the provisions regulated in articles 4 and 5 are:

  1. The LHKPN is reported no later than 3 (three) months since the first appointment/re-appointment/the end of the terms of office as a State Official.
  2. The LHKPN, while serving as State Official, is conducted periodically once every 1 year on the assets obtained from January 1 to December 31 and reported in the period of at the latest March 31 in the following year.

Implementation of LHKPN

A report in 2022 The submission LHKPN report at PT TIMAH Tbk has followed the provisions outlined in the KPK Leader Circular Letter No. 08 of 2016 concerning Technical Instructions for Submission and Management of LHKPN following the enactment of KPK Regulation No. 07 of 2016 concerning Procedures for Registration, Announcement, and Examination of State Officials’ Assets. Based on the circular letter, LHKPN reports are submitted annually no later than March 31 after the current year and through the e-LHKPN application. In 2022, 227 of the Company’s employees or 99.13% have submitted e-LHKPN reports.
